Please read this document carefully before registering or bidding. This is a legal contract that affects your rights. By registering and/or bidding (by Zoom, online, phone, absentee, or in person) for a Seized Sales auction, you (“Buyer”) agree to these Conditions of Sale with Seized Sales (the “Auctioneer”). Sale-specific written addenda, if published for an event, control for that event to the extent of any conflict. This pack is not legal advice.
Registration is free and confidential. All Buyers must register in advance before placing a bid. Completing registration (including electronic acknowledgment of these terms) constitutes acceptance of this Conditions of Sale Pack. Confirm the contracting entity name on your registration and invoice before bidding.
A 13% buyer’s premium is added to the hammer / winning bid amount on all purchases. You will receive a verbal and on-screen reminder of the premium. Do not rely on rates from prior sales. Applicable sales tax may also apply (see §11).
All items are guaranteed authentic as described and include a Certificate of Authenticity. This authenticity guarantee is in addition to, and does not expand, any other limited remedies stated herein. Except for this authenticity guarantee, lots are otherwise sold as described below.
All bids are final and binding when accepted. The highest accepted bidder has the right and obligation to purchase. Non-payment is a serious matter and unfair to other bidders; Seized Sales may pursue available remedies, including canceling the sale, reselling the lot, and recovering any deficiency, costs, and fees. Sales are final; no credits or refunds except as required by law or under the authenticity guarantee.
The Auctioneer has absolute discretion and final say regarding the conduct of the sale, including the right to refuse any bid, settle disputes between bidders, re-offer merchandise, combine or divide lots, and withdraw any lot without stated reason. The Auctioneer may place bids on behalf of other people (including absentee bidders, phone bidders, online bidders, and consignors) and/or on behalf of itself / the auction house, including consecutive bids up to a reserve, with or without disclosure. Such bidding does not create a dual-agency disclosure obligation beyond what applicable law requires.
The highest accepted bidder is obligated to purchase. In the event of a dispute between bidders, the Auctioneer’s decision is final and the lot may be re-auctioned at the Auctioneer’s discretion.
Unless the Auctioneer announces otherwise, a bid is for one item/lot only. If the Buyer requests additional identical items and the Auctioneer agrees, the bid price multiplies by the number of items awarded.
Payment is due as directed on the day of sale or as otherwise announced. Accepted methods may include major credit/debit cards, cash, check (government-issued ID required except for cash), Zelle, Venmo, Cash App, and other methods announced at the sale. A returned-check fee of $25.00 applies to all returned checks.
If you leave a live or Zoom sale early after bidding or winning, email info@seizedsales.com promptly with your full name and best phone number for payment and shipping follow-up.
Shipping costs depend on total spend and item value. Shipments are insured and require adult signature. Full shipping details are at seizedsales.com. Unless shipping is arranged, merchandise should be collected as directed on the day of the auction or as otherwise agreed. Buyer is responsible for arranging timely pickup or shipping.
Sales may be subject to applicable sales tax unless a valid resale / exemption certificate is provided as required by law.
Except for the authenticity guarantee in §3, all lots are sold as-is, where-is, with all faults. Catalog descriptions, estimates, and photographs are guides only and are not warranties of condition, value, quality, fitness for a particular purpose, or merchantability. Inspect lots when preview is offered; ask written questions before bidding. Sale-specific written addenda control for that event.
Title passes to the Buyer upon the fall of the hammer or when “SOLD” (or the online equivalent) is announced, subject to full payment and these terms. Risk of loss transfers according to the shipping/pickup arrangements in effect for the sale.
Seized Sales is an independent auction company and is not affiliated with any government agency, court, or public authority. “Seized” in the brand name refers to specialty and estate-style liquidations, not government seizure affiliation.
Any dispute arising out of or relating to this Conditions of Sale Pack, registration, bidding, or any auction conducted by Seized Sales shall be determined by binding arbitration before the American Arbitration Association under its Commercial Arbitration Rules, conducted in the County of Fulton, State of Georgia. The arbitration award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. By agreeing to these terms you give up the constitutional right to have such dispute decided in a court of law before a jury.
NOTICE: BY REGISTERING OR BIDDING, YOU AGREE TO HAVE ALL COVERED ISSUES DECIDED BY BINDING ARBITRATION AND YOU ARE GIVING UP YOUR RIGHT TO A JURY OR COURT TRIAL.
This Conditions of Sale Pack (together with any sale-specific written addenda and your registration/invoice) is the sole, final, and exclusive agreement between Seized Sales and the Buyer regarding participation in the auction, and supersedes all prior oral or written understandings on that subject. No outside representations or warranties apply except as expressly stated herein or in a written amendment published by Seized Sales.
No modification, waiver, or amendment is binding unless published in writing by Seized Sales and accepted through registration or bidding for the applicable sale (electronic acknowledgment of updated published terms for a specific sale is sufficient).
To the fullest extent permitted by law, Seized Sales is not liable for incidental, indirect, special, or consequential damages. Cumulative liability relating to any lot is limited to the amount actually paid for that lot. Any claim must be brought within six (6) months after the cause of action accrues. These limits apply regardless of the form of action (contract, tort, or otherwise) and are severable. Vendors/consignors may be third-party beneficiaries of these limitations to the extent applicable.
In any litigation or arbitration to enforce rights under this pack, the prevailing party is entitled to reasonable attorney’s fees and expenses.
